Source US Policy Editor Charles Sauer has a new article in Real Clear Markets on new antitrust guidelines released by the Federal Trade Commission and Department of Justice. He writes: “The Federal Trade Commission (FTC) and the Antitrust Division of the Department of Justice (DOJ) recently unveiled revised antitrust guidelines. The guidelines are to help the FTC and DOJ staff determine when to bring an antitrust case. As anyone who has followed the pronouncements and actions of FTC Chair Lina Khan and DOJ Antitrust Division Head Jonathan Kanter would expect, the guidelines expand the federal government’s involvement in business activity. Since penning a widely praised law review article arguing that the rise of big tech companies like Amazon necessitated an expansion of federal internet prosecutions, Khan has been a leading advocate of using government power to rein in big tech. While not as well-known as Khan, Kanter is also an advocate of this neo-Brandeisianism (named after famed Supreme Court Justice Louis Brandeis who pioneered the “big is bad” approach to antitrust). The new guidelines set forth thirteen principles that FTC and DOJ staff are to use in determining whether to attempt to block a proposed merger or acquisition. The principles focus on market concentration, competition between firms, risk coordination, market entrants, competitor supply, vertical mergers, market positions, market concentration, examination scope, platform usage, employee competition, and more squishy areas. Not only do these guidelines create a distinct end the consumer welfare standard – the general nature of the language is to throw all mergers into question and dramatically increase the power of the FTC. For instance, stating that all mergers and acquisitions can be challenged if they lessen competition among business, make the labor market less competitive, or further extend or entrench a dominant firm gives the FTC and the DOJ cart blanche to challenge virtually any and all mergers and acquisitions. One principle of particular interest is number 9: When a merger is part of a series of multiple acquisitions, the agencies may examine the whole series of acquisitions. This principle may be used to justify the agency reversing previously approved mergers and acquisitions on the grounds that since the initial approval, the business has become too big. Chair Khan and her allies are particularly interested in forcing Meta to divest itself of Instagram and WhatsApp. In fact, one of the principles states that mergers should not extend or entrench a dominant position. But the problem with this principle is that gaining, extending, and enhancing a dominant position is why businesses engage in mergers, acquisitions, and most other activities, including selling goods and services to customers. Therefore this principle essentially outlaws businesses behaving the way they should behave in a competitive market. The fact that the “big is bad” approach to antitrust could have outlawed businesses behaving like businesses is one reason that the big is bad standard was abandoned in the 1980s in favor of the consumer welfare standard. As the name implies, the consumer welfare standard judges business activity by how it affects consumers. It thus provides an objective test to determine when the government should bring an antitrust action. It also limits the ambitions of those like Lina Khan who want to use antitrust laws as a tool to reshape the American economy. Some free-market advocates say we should not be concerned about the new guidelines since the federal courts are finally limiting federal agencies’ ability to unilaterally expand their mandates beyond what Congress intended. However, the FTC and DOJ were very careful to root their guidelines in the clear statutory amendments that the laws be used to promote and ensure fairness. Therefore, it is possible a conservative court could find the principles a valid Interpretation of the FTC’s and DOJ’s congressionally granted authority.”1 point

Wikipedia, which says it offers "the second draft of history", is one of the few surviving fact-checked sources of information in Russian since the crackdown intensified after Moscow sent its armed forces into Ukraine in February 2022. The Tagansky district court said it had fined Wikimedia RUB 800,000 (nearly Rs. 8 lakh). Russian news agencies in the courtroom said Wikimedia had been charged with failing to remove materials related to a song by the alternative rock band Psychea, or Psyshit, which has been officially designated "extremist". Russia has now fined Wikimedia around RUB 9 million (nearly Rs. 90 lakh) in the past year, the agencies said. Wikimedia did not immediately respond to requests for comment. The foundation's Russia chapter has previously said it believes other fines may be overturned, but that the number of cases against it may increase, given the number of articles on Wikipedia about the conflict. Russia has for years sought to launch a home-grown online encyclopedia, without a tangible result so far. Kremlin spokesman Dmitry Peskov said on Tuesday and a Russian analogue was "absolutely necessary". "It would contain truly verified and accurate information, objective information," he said, "because we know that Wikipedia has many distortions, very many untruths, very many historical, factual and other mistakes." Russian domestic tech companies, led by entities controlled or associated with the state-owned gas giant Gazprom, have been sensing opportunities in Russia's growing digital isolation as foreign internet firms are blocked or quit Russia. Souce: Click here Microsoft is continuing to tinker with its new artificial intelligence (AI) chatbot Bing Chat, this time adjusting its personality so it’s less stubborn and more helpful. Bing Chat, which is powered by ChatGPT, garnered a lot of hype when it launched in March, allowing you to ask it all sorts of questions, and it would intelligently respond in a chat-like interface. Even better, you could ask it to create things, such as images or even code apps, and it would. However, if anyone has used it recently, you may have noticed that Bing Chat developed a bit of an attitude, and would refuse to create certain things. This is exactly what happened to me when I asked it to help me design a new operating system for an upcoming article – it stubbornly refused to help, despite quite happily doing so a few days earlier. Not only was this frustrating, but it also took a lot of the fun out of using Bing Chat. So, it’s good to see news (as reported by Neowin(opens in new tab)) that Microsoft is rolling out an update to address this. According to a tweet by Mikhail Parakhin, Microsoft's head of Advertising and Web Services, a new update is rolling out that “should see big reduction in the number of cases when Bing Chat refuses to create something (write code, for example).” More co-operative According to Parakhin, this update (known as Bing Chat v98) will roll out in two stages. The first will reduce the instances where Bing refuses to help create things, while the second stage will reduce ‘disengagements.’ I assume this refers to those, again frustrating, times when Bing Chat will consider a chat or task complete when it isn’t. Parakhin also responded to people asking about the new Bing Image Creator feature, which was recently introduced to allow users to create AI-generated art through Bing Chat, but which some people have found rather limited. Parakhin claims that this feature is rapidly improving. It's good to see Microsoft continue to improve Bing Chat – there’s a huge amount of potential here, and the company must be pleased that people are now actually interested in Bing. It certainly seems to have captured the public’s imagination in the way that rival Google’s Bard AI has not – and to keep us interested, Bing needs to keep evolving. Source click here It's almost the end of the road for Steam on some Macs. After announcing plans to stop supporting Steam for Windows 7 and 8, Valve today announced it will drop support for Macs running macOS 10.11 El Capitan and 10.12 Sierra. The company made the announcement in a short blog post on its support site. While the older versions of Windows will get dropped in Jan. 2024, the older macOS versions will get the boot earlier in Sept. 2023. Starting Sept. 1, 2023, the Steam Client will no longer run, and you'll have to update to macOS 10.13 High Sierra in order to play any games that run through Steam on your Mac. Valve is dropping support for macOS El Capitan and Sierra for the same reasons it's dropping support for Windows 7 and 8: because "core features" of Steam use an embedded version of Chrome, which won't work on these older operating systems. "In addition, future versions of Steam will require macOS feature and security updates only present in macOS 10.13 and above," the unsigned blog post reads. This change will probably affect far fewer users than the Windows announcement, as Macs aren't nearly as popular for PC gaming. In the March 2023 Steam Hardware Survey, macOS and OS X consisted of just 1.41% of systems running Steam — and of the majority of those Macs were already running macOS 13.2.1 Ventura, which is the latest version. In fact, the oldest version even captured in the survey was macOS 10.15.7, an update to Catalina, and consisted of less than 1% (of the 1.41% of macOS/OS X users). So, yeah — these changes are likely to affect very few people. Of the Macs in that survey, 54.88% were running systems with Apple Silicon, while the other 45.08% were still on Intel. El Capitan was released in 2015, with Sierra following in 2016. Security updates for those OS versions ended in 2018 and 2019, respectively. With free updates each year, there's little reason for Mac owners to not upgrade, as long as their system is still supported. Apple stopped supporting 32-bit applications in 2017, with macOS 10.13 High Sierra, which led to tons of Steam games becoming incompatible with macOS. That said, there's probably some people who will be affected by this announcement. But it looks like Valve is ready to modernize, even on this relatively minor platform.1 point

Source: Click here EA has begun gearing up for the re-branding exercise of the year, as it leaves football's world governing body FIFA in the dust and moves the series on under the brand of EA Sports FC(opens in new tab). A new press release(opens in new tab) and official site(opens in new tab) has the logo, a bunch of marketing bumpf about the glory of football, and the promise of a first detailed look at the retitled series in July. "Over the coming days, the EA Sports FC brand will debut in more than 100 matches across the biggest leagues in the world," warns EA. This is going to be the marketing blitz to end all marketing blitzes, and EA's signed up all of the world's major leagues including the Premier League, La Liga, Bundesliga, Serie A, Ligue 1, WSL, NWSL, CONMEBOL and more. In addition to this it's signed up individual teams and players who'll be repping the EA Sports FC life faithfully. The phrase EA has alighted on for this new era is "a fan-first future." Not quite sure what that means but it's the kind of lip-service that works in football, for the most part, and also slightly deflects from the endless wheelbarrows of cash being poured into this. The press release includes long quotes from various football suits about how wonderful EA Sports FC is going to be, which I'll spare you, but the masochists can find them here(opens in new tab). You thought the logo was just a logo? Think again sport. "The new brand takes its design inspiration directly from the beautiful game and a dominant shape in football culture that represents the sport in multiple dimensions, triangles." Triangles?!? Not, like, a ball? OK that's funny but EA does have a point, inasmuch as passing triangles are a key part of the game (often considered key to the Dutch 'total football' style of the 1970s), and it goes on to extend this even further: "from the isometric angles of our very first 8-bit experiences and the triangular polygons that make up every pixel of our most modern games, as well the iconic player indicator symbol that appears above every athlete in every match." Hmm. An important point to make here, which EA kind of dances around, is that players shouldn't be expecting a new game: This will be the kind of iterative improvement over last year's entry typical of the recent FIFA series, but of course that still means it'll be the best football game around by a country mile. One of the few concrete details included in this release was a reference to "the chemistry triangles that exist in Ultimate Team", FIFA's most lucrative mode by a distance, and while of course that was always going to return it does emphasise that, in the hands, this will be evolution rather than revolution. The end of FIFA as-was does make me weirdly melancholy(opens in new tab) because, cynicism aside, EA has done such a tremendous job at weaving this videogame series into the real-world sport. The FIFA games have felt for years now like an extension of whatever's going on in the sport and are embedded in the culture. I was at a match several months ago where one of Bath City's players absolutely skied a golden opportunity (sadly very common with the Romans) and some bloke on the terrace shouted "don't press circle so hard!" to chuckles all round. EA Sports FC's position and future success feels assured. FIFA, meanwhile, is all at sea. It reacted to the end of the licensing agreement like a jilted lover, with president Gianni Infantino declaring only a game with the FIFA name would be "THE BEST"(opens in new tab) (emphasis his) before going on to blow his own kneecaps off with some truly laughable tie-in efforts(opens in new tab) for the Qatar world cup.1 point
