Section 17 of the Provincial Court of Madrid has fully confirmed the dismissal of the Delcygate case, which was agreed in November by the Court that had been investigating it when it did not see evidence of a crime in the actions of the officials of the Adolfo Suárez Madrid Barajas Airport during the passage through the facilities of the Venezuelan Vice President Delcy Rodríguez.

 

In a car notified this Tuesday, the magistrates thus reject Vox's appeal against the file of the proceedings agreed by the Investigative Court number 31 of Madrid, in line with the criteria of the Prosecutor's Office, after reaching the conclusion that Rodríguez, that his access to the European Union was forbidden, he did not enter Spain when his plane landed in Barajas in January 2020 because he stayed and spent the night in a terminal hall, "airport transit area" until he "boarded another flight" .

 

In its resolution, the Provincial Court takes as a reference the conclusion reached by the Supreme Court when it ruled on the same facts in relation to the Minister of Transport José Luis Ábalos, who received Rodríguez that night and met with her and had received a complaint for trespass.

The Second Chamber shelved the investigations as it did not appreciate any evidence of a crime in the case of the minister, after considering that Rodríguez was prohibited from accessing community territory and that he spent the night of January 19 to 20 in the transit areas of the Madrid airport .

 

“These being the facts considered already accredited by the Supreme Court (which would make it unnecessary to carry out proceedings in the present case to verify them), what happens is that the Supreme Court itself, as has been said, considers that these facts do not they are constitutive of any criminal offense ", recalls now the Provincial Court.

 

It thus concludes that "in the present case there is no prevaricating or other criminal conduct, as stated by the Supreme Court, for which reason the appeal filed should be dismissed and consequently the agreed file proceeds", which is confirmed "in full" despite the appeal of Vox.
