[Sport] Peru vs. Brazil: Can referee Julio Bascuñán be separated?

More than half a million have signed a petition to remove the referee's license and just on Friday the FPF sent a claim to Conmebol. What are the possible scenarios?

The 4-2 of the last meeting between Brazil and Peru, within the framework of the South American Qualifiers for the Qatar World Cup 2022, has outraged more than half a million people who have signed a petition to remove the license of the match referee, Julio Bascuñán; But, is it really possible that they apply this sanction to the controversial referee? What are the legal channels that the Peruvian Football Federation has to claim for the decisions it made? Can the score be reversed?

So far, sources from the Peruvian Football Federation (FPF) confirmed to Peru21 that, last Friday night, the General Secretariat sent a complaint to Conmebol, but the arguments and terms of the request have not been made public.

To address the controversy, you must first rewind 18 days before the game. On September 25 in the morning, Conmebol published on its website the official list of South American referees appointed for dates 1 and 2 of the competition. From that moment, everyone already knew that the Chilean would be in charge of the bicolor match against Brazil. The leaders of the FPF, then, had every right to request a change of judge, since Bascuñán registered a reprimand for his performance. In 2013, the Referees Commission of the National Professional Soccer Association of Chile decided to sanction him for two dates for his questionable performance in the superclassic between Universidad de Chile and Colo Colo.

They appointed a referee who had very bad refereeing records. He was not suitable to continue in these tournaments. We were assigned to a person who was perfectly crossed out. In addition, Peru's next meeting will be with Chile. It was one more argument to ask that the referee be changed, ”observed José Luis Noriega, former president of the FPF's Justice Commission.

During those 18 days no one claimed, so everything continued its course and at minute 79:42 of the commitment, when Peru tied with two goals against the Latin American giant, the judge whistled a penalty in favor of Neymar on the white and red area. And until today, it seems that this action by Carlos Zambrano can only be perceived as a fault by the specialized gaze of Bascuñán and the VAR judges who have supported the decision.
UNALTERABLE MARKER

“Within 90 minutes the highest authority is the referee. No one can challenge or contradict your decisions.

 

The sanctions against the players can be reversed after an evaluation and are applied for a later date, but the goals and the points are already consummated ”, explained Marco La Jara, an expert lawyer in sports matters.
The specialist indicated that the path for Peru now is for Agustín Lozano, president of the FPF, to present a formal letter to Conmebol. "A complaint should be sent to the Conmebol Arbitration Commission regarding the appointment of referees to ensure that the weight of the rival's shirt will not exert any pressure on the judge," La Jara said.

Although there is a possibility that the Chilean referee will be sanctioned, the lawyer said that it is a remote possibility. "If Conmebol recognizes that Bascuñán has refereed badly, it would mean an implicit recognition that there were other interests in the decisions during the match," he said.

The scenario that could occur, in the opinion of La Jara, is that they “put the judge in the freezer”, that is, that Conmebol does not schedule it for any other date in competition. “Five games are coming; 12 referees are needed for each one, that is, in total there will be 60. There are approximately 500 referees in South America; therefore, freezing Bascuñán is absolutely possible ”, he concluded.

And the leaders of the Federation?

Getting the international soccer authority to take any action on the arbitration of Peru-Brazil is the task of the FPF. However, for José Luis Noriega, the questions and sanctions that Agustín Lozano, the head of the Peruvian entity, has put us in a more difficult situation.

 

“Our soccer authorities are delegitimized because Mr. President Agustín Lozano is supported by a thread. He can't even sneeze because Conmebol saved his life. He committed the most serious infraction in international football by disposing of the assets owned by a federation in his favor. This is punished with great rigor, but Conmebol only sanctioned it with a fine, "he said.

 

For the former FPF official, Bascuñán's latest arbitration represents a violation of the FIFA Fair Play code. However, the voice of national leaders is too weak to be able to protest firmly. “Conmebol can tell Mr. Lozano: please, just right there, we have saved his life, don't come to make me tangled up. I hope I'm wrong, but I think they won't 

no case to the national leadership ”, he indicated.

Lozano assumed the presidency of the FPF after Edwin Oviedo was jailed on a prosecution charge of corruption and homicide. In Noriega's opinion, the current head of the entity should be separated and, therefore, he has asked Congress to repeal Law 30727, known as the Oviedo Law, which has allowed the current president to continue in charge of our football.
