The Provincial Prosecutor's Office of Castellón -Environment and Urban Planning Section- has initiated Criminal Investigations for the investigation of the opening of four beach bars on the El Gugurú and El Pinar beaches, in Castellón, before July 1, as indicated by the Environmental group Gecen in a statement.

Gecen has pointed out that the Pativel regulation, in the case of the El Gurugú and El Pinar beaches, is a "favorable" instrument of the "essential" ecological transition that must protect against climate change and conserve biodiversity.

"Creating the necessary functional and protective green infrastructure involves respecting at least the scarce and insufficient regulations in force, the Pativel, which has not occurred," added the environmental group.

Gecen stressed that, as stated in the standard, the Pativel, it is necessary to wait until July 1 for the beach bars to open and thus respect the nesting season for the black-backed plover. "The administrative precedent, to set up and open the beach bars before July 1, cannot be applied if there is a specific mandatory rule that prevents it, the Pativel," he said.

"The regulations, obviously, are well known to Costas and for this reason, acting intentionally to breach them falls within the scope of the crime of prevarication, taking into account what is stated in the Penal Code," Gecen concluded.
