The legal plot of Factop, a factoring company owned by the brothers Ariel and Daniel Sauer, and Rodrigo Topelberg, once again has a relevant milestone. The Barber Group SpA, owned by businessman Pablo Labbé, who operates barbershops, filed a criminal complaint before the 4th Guarantee Court of Santiago against all those who are responsible for the commission of the crimes of falsification of a private commercial instrument, use malicious use of false private commercial instrument and fraud.

These are 42 false invoices issued between February 9, 2022 and May 3, 2023 by three companies and totaling $235,001,738: Inversiones DAS Limitada (7), Comercial Textil Ziko Limitada (26) and Asesorías e Inversiones ART SpA (9).

“All the previously individualized invoices are ideologically false, since there has been no source of obligation between the issuing companies and my client that has generated any obligation of the latter towards the former, of any kind,” stated the criminal action.

This complaint is the first legal attack that a company has undertaken for the false invoices issued by said companies, and it occurs a month after the audio was released in which the lawyers Luis Hermosilla and Leonarda Villalobos appear, together with Daniel Sauer, planning the eventual payment of bribes to officials of the Internal Revenue Service and the Financial Market Commission.

 

 

“As we have been able to find out and as the investigation should clarify, the purpose kept in view by all the participants in this fraud machinery, to incur in the issuance of false invoices for non-existent obligations, has been to generate executive titles transferable to light. of the provisions of Law Number 19,993, which regulates the transfer and grants executive merit to a copy of the invoice,” the letter added.

The incorporation of the company Asesorías e Inversiones ART SpA took place on September 4, 2020, before the Santiago notary office of Pedro Ricardo Reveco Hormazábal. An extract of said deed was registered on page 732, number 462, of the Commerce Registry for the year 2020, of the Registrar of Real Estate of Iquique. Its only partner is the company Inversiones Fanty SpA, whose only partner and legal representative is the defendant Bárbara Sabina Lichtman.

For its part, the company Inversiones DAS Limitada was incorporated on July 9, 2007 before the Santiago notary office of Samuel Klecky Rapaport. “After various modifications, since May 13, 2021 - before the beginning of the series of crimes that are the subject of this complaint - its partners are the defendants Daniel Amir Sauer Adlerstein, with 37.5%, Ariel Isaac Sauer Adlerstein , with 37.5%, and Rodrigo Topelberg Kleinkopf, with 25%. The administration of the company corresponds to any of the defendants,” the text states.
