[Politics] Senator Huenchumilla advocates for stricter control in municipal and regional integrity: “There is room”

Senator Francisco Huenchumilla (DC), addressed public probity and corruption this Sunday, in context with the latest cases that have been uncovered such as the Hermosilla case, the embezzlement in the Municipality of Algarrobo, or the Covenants case involving regional governments.

In an interview with CNN Chile, the legislator, when referring to the sufficiency of a legal framework to prevent these situations, clarified from the outset that “in legislative matters, all crimes of embezzlement of public funds, bribery and bribery, were updated through a law that was published in 2018, in such a way that the Penal Code contains new regulations on the matter.”

“On the other hand, this year we enacted a law on economic crimes for large companies and legal entities (…)” added the senator.

In municipal matters, the parliamentarian specified that the communal leaders have “an internal control division to supervise the use of resources in the municipality, and in addition the Municipal Council itself has the power to supervise (…) without prejudice to the power it has also the Comptroller's Office to carry out the pertinent investigations,” he clarified.

Rooms for improvement
However, the senator considered that "further legislation is probably pending (...) regarding the decentralized funds that municipalities have, and that regional governments have."

The parliamentarian recognized progress “”in the Budget Law. There are many new regulations that we hope will be definitively approved when the Budget Law comes out, we hope next Tuesday.”

The senator stressed that indeed "there is room to probably make legislation a little stricter in terms of control, especially regarding investments, bidding rules, and the justification of different projects."

Likewise, the parliamentarian extended his analysis to the background of conduct at odds with probity. “There is an issue that is no longer a criminal issue, but rather a sociological issue, of criminal psychology. In the case of audios, for example, we are dealing with people of a high economic and cultural level (...) where it is already a matter of excessive ambition, regarding using the opportunities that the possibility of earning more money by twisting their hand gives them. to the legislation,” he stated.

The parliamentarian extended the reasoning to the municipalities and regional governments: “It is likely that there is also a cultural, sociological issue, of believing the story of being the king of the commune, being the king of the region (…) in fact the mayor is the first authority, the first citizen of the commune. He does not have a boss (…) he has the Municipal Council, he has the Comptroller's Office, and the Internal Control Division. And perhaps that is insufficient, we should think about greater oversight.”
