The jurist Davor Harasic assured that the former front member was not arrested in flagrante delicto as established by the prosecution after learning the President's opinion on the case.

The lawyer of the former frontista Jorge Mateluna and former dean of the Law School of the University of Chile, Davor Harasic, distanced himself from the comments made by President Gabriel Boric on the case, assuring that he respects the rulings of justice. In an interview with Radio Cooperativa, the jurist pointed out that "I am not the one to comment on the President's statements, but indeed I, before assuming Jorge's defense, and all the professors that we assumed, were convinced that there was no proof of his guilt."

"But, we are on a different date, in which the Chilean courts issued a sentence. When a court issues a sentence, that is, and the lawyers have to abide by it, we can go to the last instance, but we have to abide by it. Consequently, what was left after an enforceable sentence: A petition for pardon and the President exercised his constitutional powers," he added. Along these lines, he maintained that "what happens is that I am very surprised at the turn that things have taken in the public discussion and I believe that people should not be confused.

The Court sentenced him, to discuss today whether it was or Not from the point of view of the legal system it is harmless, there is no way to discuss it again". "As Mateluna's lawyer, I abide by, because I have always done so, the rulings of the courts of the Republic. There is an enforceable ruling that condemns Jorge Mateluna, it makes no sense to discuss the above (...) a person was pardoned that he Chilean judicial system found him guilty and therefore he is guilty," he said. Likewise, Harasic questioned the statement of the Prosecutor's Office in which that institution defended the process that ended with his client in jail, warning that there are "two surprising things. One, that it says that he was arrested in flagrante delicto, which is the moment in which that a crime is being committed, and that is not so". "Jorge Mateluna was arrested several blocks from the scene, when he was going to the municipality, but all this was already discussed in the trial. And the second thing that the Prosecutor's Office affirms is that the Supreme Court analyzed all the evidence that exists And that's not true either," he stressed.
