The association Integridad por el Perú also denounced members of the Cabinet for the issuance of three emergency decrees that transferred items between ministries without going through the parliamentary process.

A civil association filed a constitutional complaint against the Peruvian president, Pedro Castillo, and some members of his government, for making adjustments to the budget without the approval process that had to go through Congress.

Integrity for Peru, defined on its website as a citizen movement that promotes "the development" of the country, denounced the issuance of three emergency decrees to make "unconstitutional" modifications to the budget of the Ministry of Economy and Finance, which contravenes the Articles 77, 80 and 118 of the Constitution.

In addition to Castillo, the president of the Council of Ministers, Mirtha Vásquez, and her predecessor, Guido Bellido; as well as the Minister of Economy and Finance, Pedro Francke.

Modifications
The Emergency Decree 86-2021 authorized the incorporation of 2,900 million soles (about 725 million dollars) in favor of the Economy portfolio through a complementary loan, according to the association.

Likewise, through Emergency Decree 100-2021, an additional 2,900 million soles (725 million dollars) were authorized to the Ministry of the Economy; and the transfer of 151.3 million soles (37.8 million dollars) from the budget of said portfolio was endorsed to the ministries of Agrarian Development and Irrigation and Health, as well as to various regional and local governments, to finance the execution of 44 investment works.

In Emergency Decree 105-2021, the complainants accused that the transfer of 615.2 million soles (153.8 million dollars) from the budget of the Economy portfolio to the Ministry of Labor was authorized "to finance the payment of the bond extraordinary"; and the transfer of 52.5 million soles (13.1 million dollars) in favor of governments of different levels to pay another bonus to formal workers in the private sector.

"The supplementary credits and the transfers of items are not made through emergency decrees, as the defendants have wrongly done," reads the complaint filed by the association with the Congressional Subcommittee on Constitutional Accusations.

Admission process
After the complaint presented by Integridad por Peru, the Congressional Subcommittee will analyze and assess whether the constitutional accusation is admitted, and subsequently issue a final report.

"The qualification on the admissibility or origin of the complaints will be carried out within a maximum period of ten business days", as established by the Regulations of Congress.
