NerO✩ Posted October 4, 2016 Posted October 4, 2016 Legislation As part of a more general right of access to natural areas, some countries recognize the right to camp in natural areas without prior permission of the owner. In Sweden, it is the allemansrätt - former customary right protected by the Constitution since 1994 - which lays down rules of right of way and stay on the lands of others. This customary law is also in force in Norway and Finland. Others, usually highly urbanized as Germany, Austria, Denmark and the Netherlands1, prohibit wild camping. Croatia [change | modify the code] Wild camping, and even bivouac without equipment is prohibited in Croatia, under Articles 27 and 43 of the statute "Hospitality and catering industry act". The infringements are subject to fines ranging from 150 to 1,000 €, and offenders are ordered to leave immediately. This provision is due to several reasons. First, the pollution by irresponsible visitors and the risk of fire or wildfire (ToT firefighter jargon). Next, a high rate of accidents in nature or isolated locations when visitors or tourists carry neither know nor aid kit describe their rent first aid doctors. Tourism, and therefore the associated accommodation is an important source of income for local who built many facilities provided for this purpose. Moreover, the conflict within the country during the Croatian War of Independence left or potentially mined areas affected by cluster munitions. France In France, legislation is intermediate between these two practices. Camping is not generally prohibited but it is restricted to certain areas. It is forbidden to camper2: in the woods, forests and parks that are classified as nature reserves; on public roads and paths; on the shores of the Sea; within 200 m around a water captured for consumption; in a protected area or part of the heritage protection areas and nature sites; within 500 m of a classified or registered historic building; in certain areas determined by the municipal or prefectural authorities. Regulatory signs are affixed to the usual access points prohibited areas. All car more than three months per year, excluding developed land, must be authorized by the mayor, the authorization is valid for three years. It is allowed to camp on public land wherever it is not prohibited. Council It is often banned in most cities and parks by-law. This prohibition by-law could be regarded as contrary to freedom of movement, including the right to park figure as a corollary, in the Council of State, which ruled admissible the action of a camper against a municipal bylaw prohibiting camping on the territory of a municipality (judgment of 14 February 1958 Sieur Abisset) 3. In natural parks, the camp is mostly tolerated time if there are no abuses found to avoid excessively penalizing tourism (hiking, trekking ...). See the instructions at the entrance of camping parks mentioning banned autorisé4 bivouac. Never forget that it is the owners of the plots that have primarily the right decision. Hence the Besson Law favoring the creation by the common parking lots for travelers, victims of town planning code which recognizes only one type of home. The problem is the same as for the parking of motor homes, the city of Béziers who treated the two questions together: camper and Travellers. You can practice: Be respectful of the natural living space or in which you find yourself; Minimize your installation, camping equipment is perfect (lightness and compactness in camp situation); Arrive late, leave early; Choose carefully your place; Avoid sleeping in large open places (beaches ...) Ask if you can farmers and or potential owners of plots. Switzerland [change | modify the code] No federal law prohibits camping in Switzerland5 except in nature reserves, such as districts francs. However, there are restrictions and prohibitions issued by the cantons or communes. When it comes to private property, the site is at the whim of the owner. More generally, we must distinguish the bivouac, generally tolerated and wild camping least tolerated, restricted or prohibited by location. The six board above points are also valid in Switzerland, but in any case the key word is respect. Note : An Ecologists and Photographers dream.
