The Department of Homeland Security (DHS) announced a new rule ending the automatic extension of Employment Authorization Documents (EADs) for foreign nationals applying for renewal in certain categories. The provision, which will take effect on October 30, 2025, prioritizes background checks and security investigations before granting a new work authorization. According to DHS, foreign nationals renewing their EADs on or after that date will no longer receive an automatic extension. Only limited exceptions provided by law or those announced in the Federal Register for Temporary Protected Status (TPS) beneficiaries will remain. The measure will allow U.S. Citizenship and Immigration Services (USCIS) to conduct more frequent reviews of applicants to prevent fraud and detect potential national security risks. “USCIS is placing renewed emphasis on background checks and security investigations, eliminating policies implemented by the previous administration that prioritized the convenience of foreign nationals over the safety and security of Americans,” said agency director Joseph Edlow. He added that “working in the United States is a privilege, not a right,” and stressed the importance of completing all checks before extending any employment authorization. USCIS recommended that applicants file their EAD renewal applications up to 180 days before their expiration date to avoid temporary interruptions to their work authorization.
