When asked about a possible breach of the Constitutional Court ruling on the state of exception in prisons, which did not authorize the entry of the military until the first filter, the legal secretary of the Presidency, Fabián Pozo, clarifies that the military have not entered the pavilions of the Litoral Penitentiary.

"The military are outside the pavilions of the Litoral Penitentiary," says the legal secretary of the Presidency.

Pozo explains that, between the fence that is on the street and the filter, there is quite a distance and, between the fence that faces the street and the pavilions, there is a “gigantic green area”.

The Constitution does allow the Armed Forces to act in states of exception

"What the military has done is to enter the area outside the pavilions in order to support the entry of the police to restore order within the pavilions," adds Pozo.

The official recalls that, even without a state of exception in force, Article 720 of the Comprehensive Organic Criminal Code (COIP) authorizes the intervention of the "public force" at the request of prison guides in cases of riot or serious disturbance of order in the jails.

The Ministry of Defense has not yet reported the number of military personnel involved in the operations at the Litoral Penitentiary and whether the action extends to other prisons in the country.

The Constitutional Court has not made a ruling on the matter so far. The president of the constitutional control body, Hernán Salgado, was among the authorities of other institutions and functions of the State who met with President Guillermo Lasso in the Government of Guayas. (I)
